IMPORTANT!
     For e-OLF smart card users (patents online filing):
         After a major Windows 10 update from Microsoft it is possible to get one of the following error(s) when trying to use the smart card, and not allowing you to finalize the process of online filing:
              • Cannot initialize reader connection error or OLF smartcard not recognized

         The European Patent Office (EPO) sent a notification where the issue and the cause is described, and they also provide a solution to fix this problem. EPO also asked Microsoft to fix this bug but cannot give a date when this will happen. Until then, the solution indicated by EPO works. Here you may find the notification from EPO.

Useful information to OSIM partners, that have their own e-mail servers

Our office’s e-mail servers were affected recently by the EMOTET malware and we had to implement additional security measures such as: SPF, DMARK, configuration etc.
In case your e-mails were rejected by OSIM’s e-mail server, it could be because your e-mail server does not have implemented the respective security standards.
This is the reason we kindly ask you to implement the respective security measures and before that follow the recommendations bellow that will help continue our communication:

  1. Contact us (any e-mail address with the @osim.ro suffix) using a public e-mail server (such as Gmail, Yahoo, etc) and in addition to your message, please indicate the e-mail address that is being rejected by our servers and also your contact information (e.g. phone number)
  2. OSIM will include the respective address, indicated by you, in an exception list and for a limited period of time. From that moment onward, you will be able to send e-mail to us, using that respective address.

Kindly note that this is just a temporary solution offered by OSIM, until you will upgrade the security standards of your e-mail server to the above mentioned requirements. The exception list will be kept in place for a limited time in order to avoid further malware attacks on our servers.

Communication on the time limits related to the procedures before the OSIM

Within the epidemiologic context due to the infection with SARS-CoV-2 on the territory of Romania,
Having regard to the Decree no. 195/2020 establishing the state of emergency at national level, (adopted by the Romanian Parliament Decision no. 3/19.03.2020) and the Military Ordinance no. 1/17.03.2020 on some first emergency measures on the people gatherings and cross-border movement of goods as well as Military Ordinance no. 2 on measures to prevent the spread of COVID-19,
Understanding the dificulties that the applicants for IP rights may face in carrying out the legal procedures before the OSIM,
We inform you that the OSIM’s activity will continue according to the restrictions and the internal plan of measures which triggered a special work regime,
Therefore, the applicants for IP rights are offered the possibility to file their aplications through electronic means or by post.
Having regard to the provisions of the National Committee for Special Emergency Situations and the first sentence of the Art. 2532 (9) of the Civil Code, we inform that during state of emergency establish by the Decree no. 195/202, all time limits related to the procedures before OSIM shall not run; time limits which had already run shall be suspended. The mentioned time limits will run or continue, respectively after the lifting of the state of emergency on the teritory of Romania.

Suspension of the OSIM services, as per the internal Decision 203918 of 9.03.2020 is extended until the 20 of March 2020; the respective working hours will be recovered according to a further decision, under the law.
All terms related to the ongoing procedures before OSIM having due dates between 16 and 20 March are extended until 23 March 2020, end of day.

The online filing server for patent applications, PCT national phase opening and translation of EP patents is down.
We are working to solve the problem and we will announce when the online filing services will be available again.

Due to the works programmed this Saturday – 18.01.2020 by ENEL, the electric power will be shutdown in OSIM. Thus, between 18.01.2020 – 07:00 a.m. and 19.01.2020 – 17:00 all the IT&C services provided by OSIM will be stopped.
