Amounts and time-limits for payment off fees in respect of patent applications and patents

Dear applicant or patent owner,

Please, find below the important reductions provided for by the Government Ordinance No. 41/1998 on the fees in the industrial property protection field and the conditions for using the same, as republished, in respect of the payment of fees both for the grant of a patent and the maintenance in force thereof.

Art. 2, letters A and B of the Government Ordinance No. 41/1998

on the fees in the industrial property protection field and the conditions for using the same, as republished, stipulates the categories of applicants or patent owners that may benefit by reductions in respect of the payment of fees, as well as the financial conditions for the grant of said reductions.

In case of natural persons, the amount of the average monthly gross income (AMGI) shall be calculated based on the data officially published by the National Institute of Statistics during the last 12 months.

In case of legal entities, other than research institutes, public institutions and non-profit entities, the reduction shall be granted depending on the rate of turnover achieved during the financial year preceding the date of the payment of fee and shall be calculated in LEI, at the exchange rate in force at the time of making the balance sheet.
